How to register

To become registered as a patent attorney in Australia you must meet technical, academic, residency, employment and personal criteria. To find out more information about the requirements see qualifications

Registration steps

The Board considers applications for approval of academic qualifications, exemptions, and applications for Advice of Completion of Examinable Subjects and Academic Qualifications (known as Written Statements) at meetings held usually three times a year. Please refer to the What’s New Section for the dates of the next meeting. The Secretary will take applications up until a month before the next meeting.

Step 1

Before embarking on the study of the 9 topic groups you should obtain approval of your academic qualifications (e.g. degree ) from the Professional Standards Board (Form PSB 07). Once you have passed the 9 prescribed topic groups you need to apply to the Board for Advice of Completion of Examinable Subjects and of Academic Qualifications (known as a written statement – Form PSB 08).

The Board will determine whether your qualification is a degree, etc in a field of technology that contains potentially patentable subject matter.

PSB 08 - Application for advice of completion of examinable subjects and of academic qualifications (written statement)

Once you have met all criteria, you can apply for registration on the approved form. You can apply for a Written Statement and exemptions at the same Board meeting. Applications for approval of academic qualifications can also be approved at the same Board meeting but it is preferable to seek approval of academic qualifications before embarking on study of the prescribed topic groups.

  • Ordinarily resident (provide a copy of drivers licence or rates notice)
  • Written statement (20.16)
  • Prescribed employment (proof of at least 12 months work in patent matters – provide letter or statutory declaration from employer or some other evidence of appropriate employment)
  • Statutory Declaration - offences (20.3(4) & (5))
  • Statutory Declaration - character - Please note the person who is giving the Statutory Declaration must include how long they have known the applicant and what their relationship is.
  • Use the correct Statutory Declaration form which is available on our website page: Forms Ensure that the witness has one of the qualifications listed on the form and clearly states this when witnessing.
